Terms of Service

Last updated: 25 October 2026

1. About these terms

These terms apply to your use of CladGuard Analytics, provided by CladGuard Analytics, 12 Friars Street, King's Lynn, PE30 5AP, United Kingdom ("we", "us"). By registering you agree to them. The service is intended for businesses and trades in the UK construction sector.

2. Plans, trials and payment

All prices shown include VAT:

Pro and Enterprise start with a 14-day free trial. Unless you cancel before the trial ends, the monthly subscription starts automatically at the end of the trial, and you are charged monthly in advance until you cancel. The price and renewal date are shown on the Plans tab before you confirm. You can cancel at any time from the Plans tab (Manage billing). Cancelling stops future payments, and you keep access until the end of the period you have paid for. Payments are processed by Stripe.

If you are a consumer, you have a 14-day right to cancel under the Consumer Contracts Regulations 2013. If you ask us to start the service during that period, you may have to pay for the service provided before you cancelled.

3. Your responsibility for documents

CladGuard Analytics produces draft quotations, bills of quantities, RAMS, rescue plans, COSHH registers and checklists from the information you enter. These are templates and aids only. They do not replace your own legal duties under the Health and Safety at Work etc. Act 1974, the Construction (Design and Management) Regulations 2015, the Work at Height Regulations 2005, LOLER 1998, COSHH 2002, the Control of Asbestos Regulations 2012 or any other law.

Before any document is issued or relied on, a competent person in your organisation must check that it is accurate, complete and specific to the site, and must sign it off. Prices and quantities must be checked before you quote. You are responsible for the documents you issue.

3a. Drawings, timesheets and the accident book

The drawings register, timesheets and accident book are record-keeping tools. Your company remains responsible for making sure people work from the current, approved drawings (the app marks older revisions as superseded, but you must check every issue). It is also responsible for keeping working time within the Working Time Regulations 1998 (the app's warnings are a guide only) and for reporting incidents to HSE under RIDDOR 2013 where required. The app does not report anything to HSE for you.

4. AI assistant

The AI assistant generates suggestions automatically and can be wrong or out of date. Its output is guidance only and must be reviewed by a competent person. Do not enter personal details about individuals into the assistant.

5. Acceptable use

You must give accurate details when registering, keep your password secure, and not misuse the service, try to access other users' data, or use it for anything unlawful. We may suspend accounts that break these terms.

5a. Team accounts

The account owner is responsible for who they invite, for the role each person is given, and for removing people who leave. Everyone using a company account must follow these terms. Company chat must not be used for anything unlawful, abusive or discriminatory. The account owner and contracts managers can delete messages.

6. Your content

You own the information and documents you create. You give us permission to store and process them only to provide the service. You can download or delete your data at any time. See our Privacy Notice.

6a. Data processing (UK GDPR Article 28)

When you enter personal data about other people (clients, operatives, team members, timesheets, accident reports), you are the controller and we are your processor. We will: process that data only on your documented instructions (using the service as designed) unless the law requires otherwise; make sure our staff are bound by confidentiality; keep it secure; only use the sub-processors listed in our Privacy Notice, and tell you before adding new ones; help you respond to people exercising their rights and with your security, breach-notification and impact-assessment duties; tell you without undue delay if we become aware of a personal data breach affecting your data; delete your data when you delete your account (you can export it first); and give you the information you need to show compliance. Where data is processed outside the UK, it is protected by the safeguards described in the Privacy Notice.

7. Liability

We provide the service with reasonable care and skill. Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be limited by law. Otherwise, to the extent permitted by law, we are not liable for loss of profit, business or contracts, or for losses caused by documents you issue without proper competent-person review. If you are a consumer, your statutory rights are not affected.

8. Ending your account

You can delete your account at any time from Edit My Company → Your Data & Account.

9. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (consumers in Scotland or Northern Ireland may also bring proceedings in their local courts).
